1. Definitions

Seller: Renata Rudzińska running economic activity under the company ROXANA Renata Rudzińska, Moniuszki Street 141/143 number of premises 14, Pabianice 95-200, VAT ID 731-101-26-06 

Store: online store run at www.sklep.roxana-sukienki.pl. 

Consumer: a consumer within the meaning of the Civil Code. 

Buyer: any entity buying in the Store.

Account: a free electronic service provided by the Store specified in point 13 of the Regulations, allowing the buyer to create his Account.

Contact Form: a free electronic service provided by the Store specified in point 13 of the Regulations, allowing the buyer to communicate directly with the Seller.

Newsletter: a free service provided electronically by the Store specified in point 13 of the Regulations consisting in sending information on commercial content to the email addresses provided by customers;

Working day: Monday to Friday, excluding public holidays.

Service provided electronically: a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the recipient, sent and received by means of electronic processing devices, including digital compression, and data storage, which is fully transmitted, received or transmitted via a telecommunications network within the meaning of the Act of 16 July 2004 - Telecommunications Law (Journal of Laws of 2004 No. 171 item 1800);

Regulations: these regulations, the content of which results from the requirements of art. 8 and art. 21 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2019, item 134, 730, 1495) and Art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2019, item 123, 730). The Regulations are made available to the Consumer free of charge. There is a possibility to record and print the Regulations.

  1. Technical requirements

For the functioning of the Store you need a device with Internet access, an active e-mail account and a browser that supports Java Script and cookies.

  1. The purchasing process

a. The prices of goods indicated in the store are gross prices, i.e. they include VAT.


b. The total price of the goods consists of: price for the goods and shipping costs.

c. To purchase an item, add it to the basket in the store. 

d. Then, the Buyer selects the delivery address of the goods and other data needed to complete the order. 

e. The order is placed upon confirmation of its content and acceptance of these Regulations by the Buyer.

f. Placing an order means the conclusion of a sale contract between the Seller and the Buyer. g. The Seller supply the Buyer the confirmation of the conclusion of the sales contract on a durable medium at the latest upon delivery of the goods.

h. Confirmation of order is made by making a payment.

i. The seller prepares the order when he receives payment for the ordered goods.

      1. Payment processing 

You can pay for your order via the Przelewy24 payment platform. Due to the specificity of electronic payments, payment for the order is possible only directly after placing the order.

      1. Order processing and delivery

a. The seller is obliged to deliver the goods without defects.

b. After receiving payment for the purchased goods, the Seller proceeds with the order and transfers the goods for shipment.

c. Goods purchased in the store are delivered within the territory of the Republic of Poland and abroad.

d. Goods purchased in the store are delivered by courier.
e. The deadline for delivery of the order on the territory of the Republic of Poland is up to 3 working days from the moment of posting.

f. The delivery time for orders outside the Republic of Poland is up to 7 working days from the time of posting.

      1. Right to withdraw from the contract 

a) The Consumer and Seller have the right to withdraw from the contract concluded through the Store, subject to p. 8 of the Regulations, within 14 days without giving a reason. 

b) The deadline to withdraw from the contract expires after 14 days from the day on which the consumer or a third party indicated by him (other than the carrier) came into possession of the goods; 

c) A condition for the Consumer to use his/her right of withdrawal is to inform the Seller of his decision in the form of an unequivocal statement about his decision, using the data indicated in point 2 of the Regulations.

d) The consumer may exercise the withdrawal form placed at the end of the Regulations. 

e) To meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information regarding the exercise of the right to withdraw from the contract before the withdrawal period.

 f) It is important that the withdrawal from the sales contract is accompanied by the original document confirming the purchase (receipt, invoice)

Effects of withdrawal from the contract

g) In the case of withdrawal from the contract, the Seller returns to the Consumer all payments received from him, including the costs of delivery (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual delivery method offered by the Seller), immediately and in any case not later than 14 days from the day on which the Seller informed or was informed by the Consumer about the exercise of the right of withdrawal.

h) The Seller will refund the payment to the bank account indicated by the Consumer. The consumer will not incur any fees in connection with this return.

i) The seller may suspend the refund until receipt of the goods or until proof of its return is provided.

j) The Seller asks to return the goods to the address indicated in point 2 of the Regulations immediately, and in any case not later than 14 days from the day on which the Consumer informed the Seller about withdrawal from the sales contract. The deadline is met if the consumer sends the goods back within 14 days.

k) The consumer bears the direct cost of returning the goods.

l) The consumer is only responsible for reducing the value of the goods resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the goods

m) The consumer is also requested to send back the proof of purchase (receipt / invoice)

      1. When the right of withdrawal does not apply 

The right to withdraw from a distance contract is not entitled to the Consumer in relation to the contract:

- in which the subject of the service is a non-prefabricated item manufactured according to the Consumer's specifications or serving to satisfy his individual needs.

- in which the subject of the service is an item delivered in a sealed package, which cannot be returned due to opening health protection or hygiene reasons if the packaging has been opened after delivery.

      1. Complaint procedure

a) in the event of a defect in the goods, the Buyer has the option of complaining about the defective goods under the warranty or guarantee provided for in the Civil Code, provided that the guarantee has been granted. 

b) Using the warranty, the Buyer may, on the terms and within the time limits specified in the Civil Code: 

  • submit a price reduction statement; 
  • in the event of a material defect - submit a statement of withdrawal from the contract; 
  • demand replacement of the item with a non-defective one;
  • demand that the defect be removed.

c) Complaints on the basis of warranty should be submitted to the e-mail address indicated in point 2 of the Regulations.

d) If it is necessary to deliver the advertised goods to the Seller in order to consider the complaint, the Buyer is obliged to deliver this goods, in the case of a Consumer at the expense of the seller to the address indicated in point 2 of the Regulations.

e) if a product has been given an additional warranty, information about it, as well as about its conditions, is available in the product description in the Store.

f) Complaints about the functioning of the store should be directed to the e-mail address indicated in point 2 of the Regulations.

g) The complaint will be considered by the seller within 14 days.

Out-of-court complaint consideration and redress methods

h) if the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others from:

  • mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to whom you should apply for mediation; 
  • assistance of the competent field-based amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to whom an application for arbitration should be submitted; 
  • free assistance from the municipal or poviat consumer ombudsman; 
  • the ODR internet platform available at: http: /ec.europa.eu/consumers/odr/. 

10. Processing of personal data

a) The administrator of the Buyer's personal data is the Seller.

b) Detailed information on the processing of personal data by the Seller is included in the Privacy Policy. 

11. Reservations 

a) It is prohibited for the Buyer to provide illegal content.

 b) Each order placed in the Store constitutes a separate sales contract and requires a separate acceptance of the Regulations. The contract is concluded on time and to fulfill the order.

 c) Agreements concluded on the basis of these Regulations are concluded in Polish. 

d) None of the provisions of these Regulations excludes or limits the consumer's rights under the law.

12. Buyers who are not Consumers

a) Any liability of the Seller towards the Buyer who is not a Consumer is limited to the amount of the order placed by the Buyer.

b) The seller’s liability under the warranty to the Buyer who is not a Consumer is limited to one year from the delivery of the goods to the Buyer.

c) In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the district court competent for the Seller's registered office.

13. Services provided electronically

Account service

a. Creating an Account is voluntary and depends on the will of the Buyer, and failure to create it does not result in the inability to make purchases in the Store.

b. The account gives the Buyer the opportunity to: view order history, check the status of the order, edit the Buyer's data.

c. To set up an Account, please complete the appropriate form in the Store.

d. At the time of creating the Account, an agreement is concluded between the Buyer and the Seller regarding the maintenance of the Account on the principles set out in these Regulations. The contract is concluded for a definite period, i.e. the Account will be kept in the Store by the Seller for 24 months from the date of the last purchase by the Buyer. If an Account is created and the purchase is not made, the Account shall be deleted and the contract terminated 30 days after its creation. The above solution is aimed at protecting the Buyer's personal data and implementing the principle of limited processing time of personal data.

e. The Buyer may cancel the Account at any time without incurring costs.

f. In order to resign from the Account, please send information to the Seller to the email address kontakt@roxana-sukienki.pl, which will result in immediate deletion of the Account and termination of the account agreement.

Contact Form service

The Contact Form service placed on the Store's website enables the Buyer to contact the Seller for free, direct text.

Newsletter service

The newsletter service consists of sending information about the offer and promotions of the Store www.roxana-sukienki.pl to the e-mail address provided by the recipient in the registration form.

Online chat service

The chat service consists in providing a pop-up service on the website that provides the user with direct free online contact with the Seller - online chat.

14. Amendments to the regulations

a. In the event of important reasons indicated below, the Seller has the right to amend these Regulations;

b. The important reasons are:

• The need to adapt these regulations to the law applicable to the Store;

• Improving the security conditions of the service provided;

• Introducing changes in the operation of the account that require a change in the Account regulations;

c. The Seller reserves the right to amend these Regulations at any time.

d. In the event of changes to the regulations, the Service shall be delivered to the Customer by making it available on the Store's website.

e. The changes come into force as soon as the amended text of the regulations is available on the Store's website.

f. The Buyer's use of the Website's services after making changes to the regulations is tantamount to acceptance of these changes.

The Regulations enter into force on 01-03-2020
